תקנה 24 לתקנות סדר הדין האזרחי מתירה לבית-משפט או לרשם לצרף שמו של אדם "שהיה צריך לצרפו כתובע... או שנוכחותו בבית-משפט דרושה כדי לאפשר לבית-משפט לפסוק ולהכריע ביעילות ובשלימות בכל השאלות הכרוכות בתובענה". אמנם בעבר נהגו לפרש את תקנה 24 פירוש מצמצם ובארץ אומץ פסק-הדין 273 .
